These terms govern your use of kunlabs.ai and the services provided by KunLabs AI LLC (“KunLabs”, “we”, “us”), a Delaware limited liability company at 8 The Green, Ste R, Dover, DE 19901, USA. If you sign an order form or agreement with us, that document takes priority where it differs from these terms.
1. Our services
We measure and analyse how AI assistants answer questions related to your brand, products and competitors, and we recommend or help implement changes that may improve how you are represented. Services include a free visibility check, monitoring subscriptions and project-based work, as described in your order.
2. The nature of AI results
AI assistants are operated by third parties and their answers change over time and vary between runs. Our reports describe observed results at the time and by the method stated. We do not control any AI provider and cannot guarantee that any assistant will mention, rank or recommend you, or that any specific commercial outcome will follow. Our recommendations are professional opinion, not a promise of results.
3. Your responsibilities
- Give us accurate information and have the right to share it with us.
- Only ask us to analyse brands and markets for lawful purposes.
- Where you give us access to your systems, you remain responsible for approving changes and for your own content, products and compliance.
4. Fees and payment
Fees are set out in your order or invoice. Unless stated otherwise, subscriptions are billed monthly in advance and invoices are due within 14 days. Prices exclude applicable taxes. We may suspend services for overdue amounts after giving notice.
5. Cancellation and refunds
- Free visibility check: no charge and no commitment.
- Monitoring subscriptions: cancel at any time by emailing us. Cancellation takes effect at the end of the current billing period; we do not refund partial periods.
- Project-based work: a deposit may be required to reserve capacity. If you cancel before work starts, we refund amounts paid less any agreed non-refundable deposit. Once work has started, fees for work completed are non-refundable.
- If we fail to deliver a paid service as described, tell us within 30 days and we will re-perform it or refund the fees for that portion.
6. Intellectual property
Reports and deliverables we prepare for you are yours to use for your business once paid for. We keep ownership of our software, methods, prompt sets, templates and aggregated, non-identifying insights, which we may use to improve our services.
7. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only to perform or receive the services, except where disclosure is required by law.
8. Customer listing
With your written permission, we may name you as a customer and show your logo on our website and materials. You can withdraw permission at any time by emailing us.
9. Acceptable use
Do not misuse our website or services, attempt to disrupt or reverse-engineer them, or use them to break any law or third-party terms.
10. Disclaimers
Except as expressly stated in these terms or your order, our website and services are provided “as is”, without warranties of any kind, to the extent permitted by law.
11. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability arising from the services is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Term and termination
Either party may end a subscription as set out in section 5, or immediately by notice if the other materially breaches these terms and does not fix the breach within 14 days. Sections that by their nature should survive will survive termination.
13. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. The parties will first try to resolve any dispute in good faith.
